A complete journal was kept by Mom's son Michael Demers detailing all their conversations and the events as they occured.






So, what happened at this mom's home when the evidence on this website clearly suggests that something went wrong with this delayed emergency response residential oil spill clean-up disaster.

These companies involved with this supposed clean up spent nearly one million dollars attempting to fix this $200,000 home and fighting her in court with their high priced attorneys and caused her to be displaced nearly 7 years, ruined her home and bankrupted her and as a result almost lost her home.

For the last eight years she has nothing but stress and anxiety and has not had one single break. Instead of retiring and enjoying her golden years she works 50 – 60 hours a week waitressing to make ends meet. She has suffered so much and at no fault of her own.

Her homes foundation is permeated with the smell of #2 fuel oil. A temporary soil gas vapor venting system was placed below the foundation. Although they initially installed one they removed it before finishing this supposed cleanup.

There is a notable fuel odor when entering the breezeway of the home, in the kitchen and the entire basement which is currently sealed off from the upper level of the home.

The surrounding protected wetlands are still polluted to this day 8 years later!

Enpro and it's clean-up crew invaded and trampled through Mom's home 135 times over an 18 month period, to achieve a supposed NHDES state standard clean-up.

The home still stinks of #2 Fuel Oil to this day 8 years later! Acadia Insurance Company paid Enpro Services Inc. over $300,000.00 to conduct this emergency response clean-up, which was more than the value of the home.

We believe that because of their negligence the remeidaion process took too long and the oil was allowed to enter the ground water polluting a protected wetland.

The following are the day to day notes from Dr. Geoffrey Brown of Enpro Services Inc. Dr. Brown fails to put into his report that an independent expert hired by the homeowner's insurance company was called in on multiple occassions requesting that there was a more in depth investigation into the floor slab in order to locate and find the extent of the fuel oil contamination on the property. (see expert documents section above) Dr. Brown and the NHDES ignored the expert's findings, until a phone call was made by the homeowners to New Hampshire Senator Honorable Judd Gregg.

Tuesday, February 6, 2007 - 11 :30 am. - 8:00 pm.
As per verbal request of Cliff Ambrose, President, Ambrose Environmental Management, Inc.. engage Emergency Response (ER) services to mitigate and clean-up a release of approximately 100 plus gallons of #2 Fuel Oil in a finished basement at the above referenced project location.

Wednesday, February 7, 2007 - 7:00 am. - 5:30 pm.
On site to clean up absorbents applied on February 6, 2007. Scrubbed floor with Simple Green and separated clean belongings from petroleum impacted belongings. Met with Tom Wigglesworth from Ambrose Associates and Bill Evans from the NHDES.

Thursday, February 8, 2007 - 7:00 am. - 3:30 pm.
On site to remove petroleum impacted tile and material from sink area. Removed additional tiles and mopped floor. Scrubbed impacted areas with Simple Green. Met with representative of homeowners insurance company.

Friday, February 9, 2007 - 7:00 am. - 5:30 pm.
On site to continue removing tiles, spreading speedy dry and scrubbing floor with Simple Green. Hung furnace from ceiling and completed 5 borings in basement. Submitted soil samples to laboratory for analysis.

Monday, February 12, 2007 - 7:00 am. - 6:00 pm.
On site to excavate soil at back of house and stockpile on site. Cleaned concrete in basement using peroxide and water. Vacuumed basement floor with shop-vac. Loaded debris into roll-off container. Cleaned and secured site.

Tuesday, February 13, 2007 - 7:00 am. - 5:00 pm.
On site to back-fill and compact excavation. Loaded impacted soil into roll-off container. Staged drums and waste packs on site for subsequent transportation and disposal.

Thursday, February 15, 2007 - 8:00 am. - 5:00 pm.
On site to meet with Tom Wigglesworth of Ambrose Associates and Bill Evans of the NHDES to discuss further actions in the basement. Placed polyurethane over ceiling joists and removed ceiling insulation.

Friday, February 16, 2007 - 7:00 am. - 5:00 pm.
Provided labor and equipment to cut and break concrete floor. Hand excavated petroleum contaminated soil and placed in roll-off container. Collected soil samples and put down vapor barrier.

Tuesday, February 20, 2007 - 7:00 am. - 5:00 pm.
Provided labor and equipment to install two (2) 4-inch diameter, 5-foot long injection points. Installed one (1) 1-inch monitoring well with 6-inch casing around it. Back-filled excavation with crushed stone. Sampled well and submitted to Analytics. Scrubbed floor with peroxide.

On site to restore concrete in the 7' X 4' excavation area in the basement.

Friday, May 4, 2007 - 7:00 a.m. - 3:30 p.m.
On site to support boiler in basement in preparation for the excavation of impacted soil. Placed poly sheeting on ceiling. Installed 2 X 6 boards to support floor joist for unistrut hanging.

Monday, May 7, 2007 - 7:00 a.m. - 3:00 p.m.
On site to jackhammer floor and remove concrete. Investigated area in attempt to evaluate extent of contamination.

Tuesday, May 8, 2007 - 7:00 a.m. - 4:30 p.m.
On site to continue with the removal of impacted soil from around the boiler and chimney. Placed PCS in waste packs. Emptied three drums of PCS and concrete into waste packs.

Wednesday, May 9, 2007 - 7:00 am. 5:30 p.m.
On site to pumped oil and water from recovery well in basement and excavation areas into a 55 gallon drum. Waited until 1:00 p.m. to enter house. as homeowner was late.

Friday, May 11, 2007 - 7:00 a.m. ~ 3:00 p.m.
Arrived on site. Had to wait for homeowner to arrive to gain entrance to begin pumping oily water into drum. Collected groundwater sample from well in excavation wall.

Monday, May 14, 2007 - 6:30 am. - 5:00 p.m.
On site to remove impacted soil and place into waste pack and drum. Set 5 - 1" well screens in preparation for peroxide injections.

Tuesday, May 22, 2007 – 7:00 a.m. - 4:00 p.m.
On site to mix and inject two 55 gallon drums of 17.5% peroxide into injection piping and excavations. Met with homeowner. Bill Evans of NHDES and Tom Wigglesworth. Monitored reaction.

On site to collect soil and groundwater samples after peroxide treatment. Also screened concrete block core holes with photo-ionization detector. Transportation and disposal of empty poly drum.

On site to set up blower to pull vapors from within the wall. Collected 2 surface soil samples in backyard for screening. Took PID readings from bore holes in cement block. Took PID readings after the blower was running for one hour. Collected groundwater sample from excavation recover well.

On site to fill primary drum with kerosene. Inspected drums to be sure poly on drums was secure.

Tuesday, February 5, 2008 - 10:30 am. - 12:00 pm.
On site to transfer 20 gallons of fuel from secondary drum to primary drum.

Thursday, February 7, 2008 - 8:30 am - 3:30 pm.
On site to oversee Atlas installing two tiers to support foundation. Purged both contaminated wells and filled three 55 gallon drums. Cleaned up and removed ceiling beneath room in which water leak in cast iron baseboard heating pipe occurred.

On site to vactor out soil under foundation. Back filled excavation with stone for support. Fill excavation with concrete. Vacuumed out seven 55 gallon drums and groundwater from basement.

On site to meet Simmons Plumbing to drain down heating system zone that has a leak. Installed ball valve to shut zone completely off. Re- start heat.

On site to fuel oil drums with kerosene. Removed piping, poly and plywood form from basement area. Back filled excavations with stone. Removed 5 Drums from site. Gauged, purged and sampled monitoring wells and submitted samples for laboratory analysis.

Status Report From Enpro To NHDES May 17th, 2007

On April 5th, 2007 Suzanne and Michael Demers Had a Meeting With NHDES in Concord NH and Information Was Requested About The Activities of What Was Going On At The Site From Enpro.

Eventually This Letter Was Sent. The Reason For This Meeting Was Because The Demers' Complained To Enpro and Ambrose About Strong Odors In The Home.

Enpro Tested The Areas Behind The Furnace and Detected Nothing Exceeding 2ppm Coming From Crack Behind The Furnace.

The Demers' Home Owner's Insurance Company (MMG) Hired An Expert, Who Tested The Home, and Discovered Elevated Readings of Oil Chemical Compounds Over 142ppm From The Basement Floor Behind The Furnace, and In The Air Throughout The Home.

AIR QUALITY TESTING AT THE DEMERS RESIDENCE

Early on about 3 weeks into this lengthy Oil Spill cleanup, the contractors ENPRO Services Inc. [ENPRO] And AMBROSE Environmental Management Inc. [AMBROSE] - thought that the home was clean and safe to reoccupy.

They told the Demers' that the strong petroleum odors in the home were residual odors that would go away once the home was cleaned. Michael Demers had told the contractors on several occasions that he thought more work needed to be done on the property and complained that he and his mother felt nauseous, dizzy and were getting headaches after visiting the home.

On March 7, 2007 Michael Demers took action and contacted their Homeowners Insurance Company [MMG] and MMG adjuster Mr. Matt Bigley sent an Indoor Air Quality Expert Mr. Tom Lloyd from Air Quality Management Inc. [AQM] to the home the next day on March 8, 2007 to investigate.

He did an air test of the home and discovered Elevated levels oil chemical compounds throughout the entire home. And he also discovered behind the furnace a crack in the floor that also had an elevated reading of 150ppm coming from it. This area was shown to and tested by ENPRO on two occasions prior and no readings were detected coming from this area behind the furnace?

Not only was Mom displaced from her home after the oil spill, but she was allowed by the contractors' to enter this home during the course of this lengthy cleanup and told on multiple occasions that the cleanup was complete and it was safe to enter her home…It wasn't.

Mrs. Demers became very sick from these harmful chemicals that were present in the Indoor Air of the Home. She went to the doctors and was prescribed medicine for headaches, dizziness, nausia, and lung infections.

These are symptoms of exposure to the elevated levels of #2 Fuel oil vapors that were in the air.
